Stealing for the sake of learning Torah?

Hi,

"Question: A student stole books of explanations of Torah; when the owner demanded it back, he swore not to return them before copying them, saying that some have ruled permissively regarding such theft.

"Answer: Such a ruling sins and causes sin, and one who does this violates three prohibitions… And the mitzvah he intended to perform is unsuccessful, for the sages have said that a stolen lulav is invalid…"

א' מן החברים גנב ספרי פירושים לחברו וכשתבעו ממנו נשבע ש"ח שלא יחזירם לו עד שיעתיק אותם ויש שהורו שמותר לגונבם... הו"ל בהוראתו חוטא ומחטיא והגונב יש עליו ג' לאוין... ואף אותה המצוה שנתכוין לה לא עלתה בידו שאמרו לולב הגזול והיבש פסול...

Reciting a berachah before giving tzedakah

Hi,

"We do not recite a berachah for a mitzvah which is not entirely in the control of the person performing the mitzvah, because perhaps the other party will not cooperate, and the deed will be void. Examples include tithes [of produce] for the needy, lending to the indigent, giving tzedakah, and giving gifts to a freed eved.

אין מברכין על מצוה שאינה תלויה כולה ביד העושה. מפני שאפשר שלא יתרצה בה חברו ונמצא מעשה מתבטל. כגון מתנות עניים והלואת הדלים ונתינת צדקה והענקה וכיוצא בהם.

The perils of hiring a trial lawyer

Hi,

On maintaining honesty in the courtroom:

"A defendant may not appoint an attorney to make independent claims; how could someone who does not know the truth make a claim and say, ‘Such and such happened,’ without knowing?"
