"Question: A student stole books of explanations of Torah;
when the owner demanded it back, he swore not to return them before copying
them, saying that some have ruled permissively regarding such theft.
"Answer: Such a ruling sins and causes sin, and one who does
this violates three prohibitions… And the mitzvah he intended to perform is
unsuccessful, for the sages have said that a stolen lulav is invalid…"
א' מן החברים גנב ספרי
פירושים לחברו וכשתבעו ממנו נשבע ש"ח שלא יחזירם לו עד שיעתיק אותם ויש שהורו
שמותר לגונבם... הו"ל בהוראתו חוטא ומחטיא והגונב יש עליו ג' לאוין... ואף
אותה המצוה שנתכוין לה לא עלתה בידו שאמרו לולב הגזול והיבש פסול...
